Delaware legalized adult-use marijuana in April 2023 through the passage of HB 1 and HB 2. The state has implemented a comprehensive system that includes three types of licenses within each of the four marijuana business types.
These license types consist of Open licenses, which are available to any qualified applicant, Social Equity licenses, which aim to promote diversity and inclusion within the industry; and Microbusiness licenses, tailored for small-scale operations.
Delaware has carefully considered the allocation of licenses within each business type. The state plans to issue licenses for 60 Marijuana Cultivation Facilities, allowing for a diverse range of cultivators to participate in the market. Additionally, 30 licenses are designated for Marijuana Manufacturing Facilities, facilitating the production and processing of various cannabis products. Retail Marijuana Stores are set to receive 30 licenses, providing accessible points of sale for consumers, and finally, 5 licenses have been allocated for Marijuana Testing Facilities, ensuring the quality and safety of the products in the market.
There is an application and licensing fee allocated for each business type.
